Terms of Use for PicklesBucket Website

Welcome to PicklesBucket website (the “Site”), operated by PicklesBucket LTD (“PicklesBucket,” “we,” “us,” or “our”). Your use of the Site is subject to the following Terms of Use (“Terms”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site.
1. Ownership and Use of Content
All content on the Site, including text, graphics, images, logos, and software, is the property of PicklesBucket or its content suppliers and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works of any content on the Site without our prior written permission.
By submitting any designs or other materials to us through the Site, you grant PicklesBucket a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such designs or materials throughout the world in any media.
2. User Conduct
When you create a PicklesBucket account and accept these terms you become a member of our community. During your time with us you agree to follow the ground rules outlined in these terms so please read and understand them. If you don’t accept the terms then we’ll be sad, but you will need to
leave because your presence on and use of PicklesBucket platform is conditional on your acceptance to be bound by these terms whether you
become a member or not.
You need to be 18 years or over to browse PicklesBucket. We don’t knowingly collect any information from anyone aged 18 or under. When browsing PicklesBucket you agree to follow our guidelines or instructions and keep in mind that these terms apply to any use of PicklesBucket whether or not you’re a member.
You agree not to use the Site for any unlawful, fraudulent, or malicious purpose, or in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.
You also agree not to:
- Use the Site to transmit any unsolicited or unauthorized advertising, promotional materials, or spam;
- Use the Site to impersonate any person or entity;
- Use the Site to collect or harvest any personally identifiable information, including account names and email addresses, for any purpose;
- Use the Site in a manner that violates any applicable law or regulation.
3. Membership and Subscription
To access and use PicklesBucket, you must register for an account and become a member. Registration is free, but to download files from the Site, you must purchase a subscription plan. Your subscription plan will have a limited number of downloads available to you within the subscription period. You must provide accurate and complete information when registering and keep your account information up to date. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
When you become a member you get to access our library of Items that must be used in accordance with the PicklesBucket license agreement. PicklesBucket is a single seat usage subscription only, available for use by a single real person or for a single seat usage by a company with less than fifty employees. You are not permitted to share the seat.
4. Licensing
When you download a digital file from PicklesBucket, you are granted a license to use the file as described in the licensing terms that accompany the file. The licensing terms may vary depending on the file, but in general, you are granted a non-exclusive, non-transferable, worldwide license to use the file for personal or commercial purposes. You may not sell or redistribute the file or use it in a way that violates the licensing terms.
By downloading or registering an Item you’re not actually acquiring ownership of the Item itself, only the license to use that Item. Items are subject to specific terms of use, and these terms are set out in the license agreement.
5. Payment and Fees
You can pay for your subscription via PayPal or credit card. You may be required to pay a handling fee depending on the method of payment you choose. By signing on as a member you must agree to the individual payment terms that relate to your chosen method of payment, as notified to you. You agree that at the conclusion of any time-limited free trial or introductory offer “if existed”, your subscription will automatically renew at the pricing and frequency notified to you at the start of the trial or offer.
In the event that you select an ongoing, regular payment method (for example a monthly credit card or PayPal payment) and that payment fails to occur, we may immediately suspend your subscription until payment has been made. If we suspend your subscription, your rights under these terms and the license agreement will also be suspended.
You are responsible for all costs of currency conversion relating to your PicklesBucket subscription. Your financial institution does the currency conversion and may charge you additional fees (we don’t control either the conversion rates or your financial institution’s fees).
PicklesBucket reserve the right to modify our fees at any time and will provide advance notice of any changes to our fee structure.
6. Taxes
The final prices and fees are inclusive of transactional taxes where relevant (like VAT and GST). Our promotional materials will state whether or not the price is inclusive or exclusive of transactional taxes.
You are responsible for paying all other fees and taxes associated with your use of PicklesBucket wherever levied. Your responsibility includes withholding tax if it applies, unless we already process that withholding tax. We may collect geographical location information to determine your location, which may be used for tax purposes (so location information you give us must be accurate for tax residency purposes).
7. Refunds and cancelations
We reserve the right to cancel your subscription or terminate your account at any time for any reason. You may also terminate your account at any time by contacting us. Upon termination, any outstanding fees owed to us will become immediately due and payable.
Given the nature of digital content, we do not generally offer a refund or credit on a purchased subscription unless we have made changes to these terms that materially affect you to your detriment or as required under Australian consumer law or other relevant consumer protection laws. If you would like to request a refund or credit you should contact us through our contact form.
We will assess refund or credit requests on their merits. There is generally no obligation to provide a refund or credit in situations of wrong subscription. However, you need to proceed with the refund request no later than 7 days from the order request and you didn’t use any of your download limit “you didn’t use your subscription plan to download any files”.
8. Pricing
We may offer special plans, prices or offers limited to certain geographical areas or for a limited time. We may use information such as geographical location information, or other information associated with your account or method of payment to determine your eligibility for a price, plan or offer. Eligibility for certain plans, prices or offers are determined by us at our sole discretion and we reserve the right to adjust the pricing for your subscription in the event that we determine you are not eligible for a particular plan, price or offer, on the basis of your geographic location or any other certain conditions.
We may change our pricing at any time, however any price changes will apply no earlier than 21 days following notice to you.
9. Intellectual Property
All digital files on PicklesBucket are the property of their respective owners and are protected by copyright law. You may not use any digital file on PicklesBucket in a way that infringes on the intellectual property rights of the owner. You agree to indemnify and hold us harmless from any claims or damages arising from any alleged infringement by your use of a file.
We do not own the Items on PicklesBucket; the Item sellers do. However, we have the right to sublicense the Items to you on the terms of the license agreement.
We own all the trademarks, logos, service marks and trade names on PicklesBucket (unless otherwise stated and excluding these things owned by others). You will not copy, distribute, modify or make derivative works of any of our PicklesBucket Content or use any of our intellectual property in any way not expressly stated in these terms.
We respect the intellectual property rights of others. If you believe that an Item or any content on PicklesBucket infringes any intellectual property right (including copyright) please contact us.
10. Quality Control and Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. PicklesBucket disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
PicklesBucket does not warrant that the Site will meet your requirements, or that the Site will be uninterrupted, timely, secure, or error-free. PicklesBucket does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations.
We perform quality control on the files available on PicklesBucket to ensure the highest quality. However, we make no warranties or representations about the accuracy or completeness of the files on our Site. We do not guarantee that PicklesBucket will be error-free or uninterrupted, or that any defects will be corrected
11. Availability and Support
We strive to have PicklesBucket available to you 24 hours a day, seven days a week but you know how the internet works: occasionally you might not be able to access PicklesBucket, and this might happen for any reason, at any time, with or without notice, or at our absolute discretion. We might also change aspects of how PicklesBucket works, including the kinds of Items available on PicklesBucket. PicklesBucket LTD will not be liable to you for any loss you suffer as a result of these things.
Our support is limited to the use of our Site only. We do not offer after sales support to the files themselves. If you have any questions or comments about a file, please contact the owner of the file directly.
12. Limitation of Liability
In no event shall PicklesBucket be liable for any direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of the Site or the inability to use the Site, even if PicklesBucket has been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless PicklesBucket, its affiliates, officers, directors, employees, agents, and suppliers, from and against any claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Site, your breach of these Terms, or your violation of any law or the rights of any third party.
14. Promotional Use of Designs
By submitting any designs or other materials to us through the Site, you acknowledge and agree that PicklesBucket may use such designs or materials for promotional purposes, including on our website, social media channels, and other marketing materials.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising out of or relating to these Terms or your use of the Site.
16. Changes to these Terms
PicklesBucket reserves the right to modify these Terms at any time, in its sole discretion. If we make any material changes, we will notify you by email or by posting a notice on our Site prior to the effective date of the changes.
